Terms of Participation

Gecko Labs Pte. Ltd. (“CoinGecko”, “we”, “our”, or “Company”) is proud to present CoinGecko 2024 (“Event”)!  Thank you for your interest in participating in the Event on 11th November 2024 which will be available online and onsite at the physical Event venue.

By registering for, participating in, attending, or accessing the Event, you will be deemed to have accepted all the terms and conditions (“Event Terms”) as set forth herein, in addition to our Privacy Policy (“Privacy Policy”) and Website Terms and Conditions (“Website Terms”), which shall collectively constitute a binding contract (“Agreement”) between you and our Company.  Please therefore read the following Event Terms as well as the Privacy Policy and Website Terms carefully, and should you not agree to any of the provisions, please do not sign up for, register, access or participate in the Event.  Furthermore, we reserve the right to update, modify, amend or vary any terms of the Agreement in our sole discretion at any time without any notice or liability to you, as such you agree that it is your sole responsibility to check the Agreement (which is accessible online) regularly to ensure that you agree with all terms of the Agreement, because your continued participation in, attendance at, or access to, our Event shall constitute your agreement to the updated/amended terms of the Agreement.

Please therefore read the following Event Terms carefully, and should you not agree to any of the provisions, please do not sign up for, register, attend, access or participate in the Event.

In the event of any conflict, inconsistency or ambiguity between these Event Terms, the Privacy Policy and/or the Website Terms, the Privacy Policy shall take precedence, followed by these Event Terms, and lastly the Website Terms. 

1.    Event Registration 

1.1   As the physical Event venue can only host a limited number of persons, you are strongly encouraged to register online and purchase your ticket in advance to ensure that your access to the Event is secured. There will be no tickets available for purchase onsite at the Event venue itself.

1.2   For online purchase of tickets, please register for the Event using our online form found at https://events.hubilo.com/geckocon-2024/register. Please note that the registration for, management of, and access to the Event is via the use of a third party platform known as “Hubilo”.  Therefore when you register for the Event, purchase a ticket for the Event, or attend the virtual Event online, please note that in addition to these Event Terms, our Privacy Policy and Website Terms, the terms of “Hubilo” shall also apply, and such terms are accessible at https://legal.hubilo.com/terms/2719.  Please read to ensure that you fully agree to the aforesaid terms of “Hubilo” (as well as any other terms applicable on their website that Hubilo may from time to time introduce) before you sign up for or access our Event virtually. 

1.3   For successful registration and purchase of tickets to the Event, all fields indicated as mandatory must be fully and accurately completed. In the event that any mandatory fields are not completed, we will not be able to complete your registration, issue you a ticket, and/or you may be denied access to the Event.

1.4   Your Personal Data (as defined in our Privacy Policy) will need to be provided to us in order for us to successfully register you for the Event, issue you a ticket to the Event, allow your participation in or access to the Event (which would therefore also include, without limitation, communicating with you in order to improve the Event registration experience and Event attendance experience). Therefore by registering for the Event, you are consenting to our collection, use, storage and processing of your Personal Data as may be relevant for the foregoing purposes.  The management of your Personal Data will be as set forth in our Privacy Policy.  Please therefore review our Privacy Policy carefully to ensure that you consent to all terms therein before registering for the Event.

2.   Event Access

2.1   The benefits and scope of access that you will have to the Event will be dependent on the tier/category of your purchased ticket:-

2.1.1   VIP Pass: Grants access to the conference area, exhibition area, lunch and dinner, virtual conference, virtual exhibition and the river cruise.

2.1.2   Conference Pass: Grants access to the conference area, exhibition area, virtual conference and virtual exhibition but does not include the river cruise.

2.1.3   General Pass: Provides access only to the exhibition area.

2.1.4   Virtual Pass: Provides access to the virtual conference, virtual exhibition, and virtual river cruise.

Please consider carefully which tier/category of ticket you would like before purchasing, because no exchange, transfer or refund will be permitted.  If you wish to upgrade your tier/category of ticket, you will need to purchase another new ticket.  For the avoidance of doubt, (i) your ticket is non-transferable under any circumstances, and (ii) “virtual conference” refers to a live feed from the Event  (which will include the presentations and activities (such as the river cruise) that are taking place physically at the Event venue) that you can access online.

2.2   For VIP Pass and Conference Pass, please be at the location(s) identified in the Event program and/or as indicated by the signs at the Event Venue at the relevant times in order to enjoy the benefits of your ticket. We will not be howsoever liable nor will a refund (pro-rated or otherwise) be provided if you miss the river cruise, lunch, dinner, any presentations, or any other activities.  Kindly note that the meals provided will not be halal, however, vegetarian options will be made available.

2.3   For Virtual Pass, please follow instructions that will be given on the webpage that you will be provided with a link to and login using the ID and password assigned to you. Under the Virtual Pass, you will be able to view presentations conducted on-site at the venue, as well as live feeds of certain areas of the venue and river cruise, however we cannot guarantee that you will be able to view the entire venue, the detail at which you can view the Event, the clarity of any audio feed, or any other specific requirements or expectations that you may have.

2.4   Event Venue and timing:

However, we reserve the right to change the venue and/or Event timing at any time in our sole discretion without any prior notice or liability or refund to you.  Please therefore check https://conference.coingecko.com regularly to ensure that you make your way to the correct venue location for the Event. 

2.5   Due to the limited number of persons that the Event venue can accommodate, notwithstanding that you may have purchased a ticket in advance online, you may still be required to queue and/or wait outside the Event venue for other participants to exit before you will be permitted entry in the event that it is at full capacity.

2.6   Entry to the physical Event venue may be subject to the venue owner’s (in addition to CoinGecko’s Event Terms) prevailing terms and conditions for entry. All children below 12 years of age attending the physical Event at the venue must be accompanied by a parent or legal guardian, and such parent or legal guardian must agree on behalf of the child to all terms (including without limitation Section 7 on use of Images of the child as an attendee of the Event) herein this Event Terms.  Neither CoinGecko nor any of its Third Party Participants (as defined in Clause 7.1 below) shall be howsoever responsible for any minors left unattended at the Event venue.

2.7   Additional Terms for accessing the Event virtually

2.7.1   If you are accessing the Event virtually:-

2.7.1.1   You agree, understand and accept that your access to the Event virtually via the internet may be prevented and/or interrupted by circumstances beyond the reasonable control of CoinGecko including, without limitation, unavailability or interruption of the Internet or other electronic or telecommunication services and network transmissions (“Disruption Incident“). CoinGecko will not be responsible or liable for any losses and/or indirect or consequential damages arising out of or in connection with any such Disruption Incident.

2.7.1.2   You are solely responsible for providing, at your own expense, all equipment necessary to access the Virtual Event, including but not limited to a computer, tablet or smart phone, and Internet access (including payment of third party charges associated with such access, as applicable).

2.7.2   In order to access the Event virtually, you may be required to configure your software settings on your equipment upon first use, to download the software for the operating system, and/or to create an account and password with a third-party platform service provider.

2.7.3   Any registration data provided by you to the third-party platform service provider, is subject to their terms and conditions. CoinGecko disclaims any liability for the third-party platform service provider’s use of any registration data that you provide to them. Please read such third party service provider’s terms and conditions, privacy policy and any other applicable terms of use carefully to ensure that you agree to and comply with them.  Otherwise, please do not access or use such third-party platform (nonetheless, CoinGecko shall not refund or compensate you for your ticket).

2.7.4   You are solely responsible for maintaining the confidentiality of your password and account with the third-party platform service provider and for any and all statements made and acts or omissions that occur through the use of the password and account, including any messaging/online chat channel, email or other forms of communication sent and any charges incurred.

2.7.5   The Event and any recordings thereto are to be viewed only by ticket-holder who had registered to access the Event virtually – such content must under no circumstances be recorded, modified, uploaded, posted, transmitted, republished, distributed, used, adapted, reproduced, translated, or copied for any purpose whatsoever without prior written permission from CoinGecko.

2.7.6   You further acknowledge and agree that:

2.7.6.1  As an attendee of the Event virtually, you are solely responsible for any content that you post, communicate or otherwise make available on or through the Event accessed by you virtually or the platform associated thereto, including without limitation, the accuracy of your content, reliability, nature, rights clearance, compliance with applicable law. Any content made available by the you thereto are not considered confidential by CoinGecko and may be displayed, disseminated or used by CoinGecko without prior notice or attribution to you, compensation or liability.

2.7.6.2  By posting information in or otherwise using any communications service, chat room, message board, newsgroup, software library, or other interactive service that may be available to you through your access to the Event virtually, you agree that you will not communicate, upload, share, post, or otherwise distribute or facilitate distribution of any content including text, communications, software, images, sounds, data, or other information that:

2.7.6.3  is unlawful, threatening, abusive, harassing, defamatory, libelous, discriminatory, degrading, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions, or would otherwise be deemed disrespectful towards another individual or group of individuals;

2.7.6.4  infringes any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party;

2.7.6.5  constitutes unauthorised or unsolicited advertising, spam email, chain letters, multi-level marketing, any other form of unauthorized solicitation, or any form of lottery or gambling;

2.7.6.6  transmits software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party, or impersonates any person or entity, including any of our employees or representatives.

2.7.7   All content, including without limitation any content made available by attendees of the Event virtually are not monitored by CoinGecko. CoinGecko does not pre-screen nor do we exercise editorial control over content, and are not howsoever responsible for the same.

2.7.8   CoinGecko may, in our sole and absolute discretion (but without the obligation to), screen, delete and/or remove any content made available by any attendees of the Event virtually if CoinGecko receives a complaint from another attendee or a notice of intellectual property infringement or other legal instruction for removal, or which in our sole and absolute opinion violates these Event Terms, or is otherwise illegal or objectionable, or any other reason as determined by CoinGecko in its sole discretion. You agree that CoinGecko may use automated systems that analyse any content made available by those who attend the Event virtually to help detect infringement and abuse, such as spam, malware, and illegal content.

2.7.9   CoinGecko may in its sole discretion (but is not obligated) to block communication by any persons attending the Event virtually (including but not limited to feedback, postings, messages and/or chats) of such persons as part of our effort in protecting the Event (online or offline) or our other Event attendees, or otherwise enforcing the provisions of these Event Terms, without any refund or compensation of any kind.

3. Price of Ticket

3.1    All prices stated are exclusive of the applicable Value Added Tax/Goods and Services Tax (“GST”). All transactions will be denominated in USD, and the applicable GST will be charged on top of your ticket price. CoinGecko is not responsible for any currency conversion rates used by the banks or credit card companies or administrative fees charged by the payment gateway for transactions made via our Event registration platform.

3.2    While CoinGecko shall make every reasonable effort to ensure that the prices and descriptions indicated on our Event webpage(s) is correct, nonetheless, we will not be held liable for any pricing or description errors.  All prices are subject to changes without prior notice.

3.3    Full payment for your ticket must be received by CoinGecko before your ticket will be issued to you, nor will you be permitted access to or participation (whether virtually or physically) in the Event in the event that CoinGecko does not receive full payment from you for whatever reasons.

3.4    You will be directed to a third party payment gateway for transacting payment for your ticket.  For security purposes, such third party payment gateway will ensure that all payment information and payments received are encrypted through Secure Socket Layer technology to ensure that information submitted is protected. However, as such payment gateway is provided by a third party and not under the control or supervision of CoinGecko, you agree that any loss or damage incurred or sustained by you in relation to the purchasing of a ticket for the Event shall be borne solely and exclusively by you.  UNDER NO CIRCUMSTANCES WILL COINGECKO BE HOWSOEVER LIABLE FOR ANY LOSS, DAMAGE, OR INJURY OF ANY KIND CAUSED AS A RESULT OF PAYMENT (OR ATTEMPTED PAYMENT) MADE VIA OUR WEBSITE, THE PAYMENT GATEWAY OR IN CONNECTION WITH THE EVENT.  Please contact your credit/debit card provider immediately if any fraudulent transactions appear on your credit/debit card statements. All enquiries pertaining to these matters should be put to your credit/debit card issuer.

4. Acceptance Of Registrations 

4.1    All registrations to the Event shall be subject to the capacity of the Event venue, and therefore any ticket availability is subject to change without notice to you.  CoinGecko reserves the right to refuse any registrations for the Event that it receives for any reason. In particular, without limiting the generality of CoinGecko’s right to refuse a registration, CoinGecko hereby reserves the right to cancel or refuse any registrations where full payment is not made by the due date indicated online.

4.2    No contract of sale shall be deemed concluded between CoinGecko and you until CoinGecko confirms its acceptance of your registration and receipt of the price of your ticket in full.

4.3    CoinGecko does not accept any registrations or purchase of tickets by entities (including without limitation, incorporations, partnerships and individuals) resident or domiciled in any of the countries listed on https://landing.coingecko.com/excluded-countries/ (“Excluded Countries”).  CoinGecko reserves the right to deny entry or access to the Event to a person from any of the Excluded Countries (even if such person had successfully purchased a ticket), and amend the list of Excluded Countries in its sole discretion from time to time (regardless of whether any of the listed Excluded Countries are indeed sanctioned by OFAC or have been removed from the list of sanctioned countries maintained by OFAC or added only after you have purchased a Ticket).  You agree that it is your responsibility to check the list of Excluded Countries on https://landing.coingecko.com/excluded-countries/before you register for or purchase a ticket to the Event, and to declare truthfully your residency or domicile when registering or purchasing a ticket for the Event. 

5. Postponement & Cancellation Policy

5.1    If the Event is postponed, CoinGecko shall give notice of such postponement to the ticket holders as soon as reasonably practicable. No refunds will be given except in the sole discretion of CoinGecko.

5.2    CoinGecko reserves the right, at its sole and absolute discretion, to terminate this Agreement and/or cancel the Event (in its entirety or any part thereof) without notice or reason and there shall be no recourse or liability against CoinGecko. Upon termination of this Agreement or cancellation of the Event entirely, CoinGecko shall refund the price of your ticket, and this shall constitute your sole and exclusive remedy for the cancellation of the Event.  You agree that upon your receipt of the refund of your ticket price, all rights and other remedies that you may have against CoinGecko (whether in tort, contract, equity or at law) shall be waived and you will not commence any claims or legal actions against CoinGecko in relation to the cancellation of the Event. CoinGecko shall, in no event, be liable for any, cost, damage or loss incurred by you in the event of cancellation of the Event, including without limitation your credit card administrative costs, currency conversion losses, hotel costs and airfares that you may have paid in anticipation of attending the Event.

5.3    Any refund pursuant to Clause 5.2 above shall be made to your credit/debit card used for the purchase of your ticket that is being refunded, excluding any interchange fees, administration fees, currency conversion costs, and any other amounts that you paid to any third parties in relation to your purchase of the ticket online (even if the amounts were charged by the payment gateway linked to our Event registration webpage).

5.4    No refunds of any kind will be provided to you once you have purchased your ticket, regardless of the reasons you may have for seeking cancellation of your purchased ticket.  No transfer or resale of your ticket, or substitution of attendee will be permitted.  Please therefore consider carefully before you purchase a ticket to the Event.

5.5    For the avoidance of doubt, in the event that you are a resident of an Excluded Country and you are able to register for, or purchase a ticket to, the Event, we reserve the right to cancel your ticket or deny entry/access to the Event without any liability or refund (in whole or in part) to you.

6. Use Of Collected Information

6.1    CoinGecko utilizes industry standard means (physical, electronic, and administrative safeguards) to protect your Personal Data from unauthorised access, including maintaining strict confidentiality of Personal Data submitted online by users/customers, further details of which are set forth in our Privacy Policy. “Personal Data” refers to information that can be used singly or in conjunction with other available (or likely to be accessible) information to identify an individual, including without limitation, name, phone number, email, and other personal information.  Your personal data will be used for the purpose of providing you with access to the Event (including without limitation any updates, program details, location guide, and any other relevant information) and pursuant to our Privacy Policy.  If you should consent/opt-in, you may occasionally receive information from us for the purpose of informing you of upcoming other events, new products, new services and promotions (collectively, “Promotional Materials”). If you do not want to continue receiving such Promotional Materials from us after having opted in, please click on the “Unsubscribe” link provided in the message containing the Promotional Materials.

6.2    In general, (unless you have opted-in to receive Promotional Materials), CoinGecko will only use your Personal Data you provide to respond to any queries you may have regarding the Event, to process your registration request, the purchase of your ticket, and provide information relevant to the Event. However, we may share the Personal Data you provide to us with third party vendors (“Third Party Vendors”) that we have engaged to provide us with services and/or assistance in relation to the Event. The sharing of Personal Data with such Third Party Vendors will only be limited to the extent required for these Third Party Vendors to provide us with such services or assistance in relation to the Event.  These Third Party Vendors will be contractually bound to use Personal Data we share with them only to perform the obligations for which they were engaged. We do not share, sell, or lease Personal Data about you to any third parties for their advertising or marketing use unless you have consented thereto (subject to Section 7 below). Except as set forth in these Event Terms and our Privacy Policy, we will not disclose your Personal Data unless with your prior consent or if we are required by law to do so, or in other legally limited circumstances (such as to protect your account from fraud).

6.3    If you are currently a resident in the European Union governed by the EU GDPR, upon successful registration for the Event, you will be deemed to have provided consent to the storage and processing of your Personal Data (including name, job title, company, e-mail address, and telephone number) for the purpose of enabling your attendance at or access to the Event, and should you be caught in our video recording or live feed of the Event (as further described in Section 7 below), you will be deemed to have additionally consented to the storage, processing and display of your Images for the virtual version of the Event and our publicity purposes.

7.Consent To The Use Of Images

7.1    By registering for, and/or your attendance at, the Event, you are hereby granting your consent to CoinGecko, our employees, agents and third party companies participating as sponsors, presenters, speakers or booth operators (collectively, “Third Party Participants”) to record your visual/audio images, including, but not limited to, photographs, digital images, voices, sound or video recordings, audio or video  clips (collectively, “your Images”), and to use such of your Images  for any of the Third Party Participants’ purposes, including without limitation for display on our and the respective Third Party Participants’ websites and as publicity for the Event or our company or any of the Third Party Participants, with or without written descriptions accompanying any of your Images, without attribution to you, and, without notifying or liability to you or providing any compensation to you thereto.  You further automatically assign to CoinGecko any intellectual property rights and moral rights that may arise or you may be deemed to possess in relation to such Images, and where any such rights cannot be assigned, you agree to waive your exercise of such rights and/or to not raise any objections in relation to our or any of the Third Party Participant’s use of the Images.

7.2    If you are currently a resident in the European Union, governed by the EU GDPR, upon successful registration for the Event, you have provided consent to the collection and processing of Images of yourself during your participation in the Event. You further consent to our and the Third Party Participants’ use of these Images for display, publicity and marketing purposes, which shall include but is not limited to display on our and/or the Third Party Participants’ respective websites, social media accounts, and/or post-event emails. You may withdraw your consent at any time by sending an email to conference@coingecko.com. Please also refer to our Privacy Statement for more details on our policies regarding your Personal Data.

8. Unauthorised Recording

You agree not to record or digitise any parts of the Event or its proceedings without prior written consent from CoinGecko. If you attempt to conduct any unauthorised recording, CoinGecko reserves the right to request for your immediate removal from the Event premises and to delete any unauthorised recordings made in whatever form.

9. Disclaimers

9.1    All information and content regarding the Event on our website have been diligently reviewed to minimize inaccuracies.  Nonetheless, we make no representation or warranty (whether express or implied) as to the completeness, updatedness, or accuracy of such information and content.

9.2    Although we will use our good faith endeavours to provide the Event, nonetheless, no representations or warranties (whether express or implied) of any kind are provided, including without limitation there being no warranties as to the quality, enjoyability, informativeness, ambience, environment, taste of food, suitability or quantity of food, the size of the crowd, number of third party booths, the performance of such third party booths,  performance of presentations, content of presentations, quality or quantity of goodie bags and their content, or the enjoyability or duration of river cruise.

9.3    FOR THE AVOIDANCE OF DOUBT, ALL INFORMATION AND CONTENT REGARDING THE EVENT ON OUR WEBSITE (INCLUDING WITHOUT LIMITATION THE REGISTRATION FORM), AND THE PROVISION OF THE EVENT ITSELF, ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES (DIRECT OR INDIRECT) OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, COINGECKO DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES WHATSOEVER AND HEREBY DISCLAIMS ALL WARRANTIES (EXPRESS, IMPLIED OR STATUTORY) OF ANY KIND TO YOU OR ANY THIRD PARTY INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY ON CORRECTNESS, ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, NON-INFRINGEMENT, ERROR-FREE, NON-DEFECTIVENESS, FREE FROM ANY VIRUS, WORMS OR OTHER HARMFUL ELEMENTS, TITLE, ANY RESULTS, IMPLIED WARRANTY OF SATISFACTORY QUALITY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE (EVEN IF COINGECKO HAS BEEN ADVISED IN ADVANCE OF SUCH PURPOSE), WHETHER ARISING FROM USAGE OR CUSTOM OR TRADE OR BY OPERATION OF LAW OR OTHERWISE.

9.4    All information and views expressed by the speakers or presenters or the third part operated booths and exhibitors (collectively, the “Third Party Participants”) at the Event are solely their own and CoinGecko therefore disclaims any responsibility for any of the information, content, materials or views made available at the Event. Without limiting the generality of the other provisions hereunder this Section 9, you further acknowledge and agree that CoinGecko makes no warranties or representations in respect of, nor does CoinGecko guarantee the accuracy, timeliness, completeness, integrity or quality of any information or any other content or material which may be made available by such Third Party Participants at the Event.  The Third Party Participants shall ensure their respective rightful ownership of any copyright and any other intellectual property rights in their presentation materials and that any facts, representations, statements whatsoever made in these materials are true and accurate, and CoinGecko shall be in no way liable for these information and materials.

9.5    UNDER NO CIRCUMSTANCES WILL COINGECKO BE LIABLE FOR ANY INJURY, DAMAGE OR LOSS OF ANY KIND CAUSED AS A RESULT (DIRECT OR INDIRECT) OF THE USE OF THE WEBSITE, THE EVENT REGISTRATION PAGE, AND/OR YOUR ACCESS TO THE EVENT, INCLUDING BUT NOT LIMITED TO ANY INJURY, DAMAGE OR LOSS SUFFERED AS A RESULT OF RELIANCE ON THE CONTENT PROVIDED ON OUR WEBSITE OR AT THE EVENT, AND YOU AGREE THAT COINGECKO SHALL ALSO HAVE NO LIABILITY WITH REGARDS TO THE PERFORMANCE, ACTS OR OMISSIONS (WHETHER INTENTIONAL OR INADVERTENT, NEGLIGENT OR OTHERWISE) OF ANY THIRD PARTIES PARTICIPATING IN THE EVENT.   

9.6    COINGECKO IS NOT RESPONSIBLE FOR THE INTERACTION BETWEEN YOU AND THE THIRD PARTY PARTICIPANTS PARTICIPATING IN THE EVENT AND/OR OTHER ATTENDEES. COINGECKO IS NOT RESPONSIBLE FOR DISPUTES, CLAIMS, LOSSES, INJURIES, OR DAMAGE OF ANY KIND THAT MIGHT ARISE OUT OF OR RELATE TO CONDUCT OF THE AFORESAID THIRD PARTY PARTICIPANTS AND/OR OTHER ATTENDEES OF THE EVENT, INCLUDING, BUT NOT LIMITED TO, YOUR RELIANCE UPON ANY INFORMATION PROVIDED BY THE THIRD PARTY PARTICIPANTS AND/OR OTHER ATTENDEES.  COINGECKO DOES NOT CONTROL CONTENT FROM THE THIRD PARTY PARTICIPANTS AND/OR OTHER ATTENDEES AND, AS SUCH, DO NOT GUARANTEE IN ANY MANNER THE RELIABILITY, VALIDITY, ACCURACY OR TRUTHFULNESS OF SUCH CONTENT. YOU ALSO UNDERSTAND THAT INTERACTING WITH SUCH THIRD PARTY PARTICIPANTS AND/OR OTHER ATTENDEES MAY EXPOSE YOU TO CONTENT THAT YOU CONSIDER OFFENSIVE, INDECENT, OR OBJECTIONABLE. COINGECKO HAS NO RESPONSIBILITY TO KEEP SUCH CONTENT FROM YOU AND NO LIABILITY THERETO, TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW. FURTHER, COINGECKO CANNOT AND DOES NOT GUARANTEE THAT ANY PERSONAL DATA SUPPLIED BY YOU WILL NOT BE MISAPPROPRIATED, INTERCEPTED, DELETED, DESTROYED OR USED BY OTHERS.

9.7    You acknowledge that your reliance or use of any information on our website, access to the Event, and use of any information obtained from the Event, shall be at your sole risk.  For the avoidance of doubt, CoinGecko does not hold itself out to provide (whether in its content related to the Event or at the Event itself) any investment advice or financial information for which a licence from the Monetary Authority of Singapore will be needed.  

9.8    CoinGecko reserves all rights, in its sole discretion, to correct any errors or omissions in any portion of the content on its website regarding the Event when such errors or omissions come to the attention of CoinGecko. In addition, CoinGecko further reserves all rights to make any other changes to the content regarding the Event on its website (including without limitation its program, features, presentations, materials, products, services or prices) at any time without notice or liability to you.

9.9    CoinGecko shall not be howsoever liable to you for any disruptions, changes or cancellations during or howsoever related to the Event caused by unforeseen circumstances or circumstances outside of its control (including without limitation sudden closure of Event venue by the property owner, strikes, labour disputes, civil unrest, natural catastrophes, and/or implementation of laws, regulations or restrictions by governmental authorities). 

9.10 CoinGecko reserves the right to substitute or change any booths, presenters, speakers, presentations, goodie bags, food, river cruise operator or other features of the Event at any time in its sole discretion without notice or liability to you, and no refunds will be provided on the basis of such changes.

9.11   Without limiting the generality of any of the other provisions hereunder this Section 9, you understand that any goodie bags or free gifts available at the Event shall be subject to availability, and there are no guarantees of any kind in relation to such goodie bags and their contents, or free gifts (including without limitation the quantity, quality, usability, fitness for purpose or merchantability).  You understand and agree that your acceptance and/or use of any such goodie bags or free gifts is entirely at your sole discretion and risk, and neither CoinGecko nor any of the third parties providing such goodie bags or free gifts shall be howsoever liable to you for any injuries, losses or damages that you may suffer in relation to the said goodie bags (and their contents) or free gifts.

10. Limitations Of Liability 

10.1  IN NO EVENT SHALL COINGECKO OR ANY OF ITS RELATED COMPANIES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE OR OTHER DAMAGES (INCLUDING WITHOUT LIMITATION, ANY LOSS OF OPPORTUNITIES, LOSS OF TIME, LOSS OF CONTRACT, LOSS OF INCOME, REVENUE OR PROFITS, BUSINESS INTERRUPTION, LOSS OR DAMAGE OF DATA, EQUIPMENT OR PROGRAMS OR OTHER PROPERTY) ARISING DIRECTLY OR INDIRECTLY FROM YOUR USE OF OUR WEBSITE, YOUR REGISTRATION FOR THE EVENT, YOUR ATTENDANCE AT OR ACCESS TO THE EVENT, YOUR RELIANCE ON ANY INFORMATION RELATED TO OR PROCURED FROM THE EVENT (WHETHER FROM COINGECK OR ANY THIRD PARTIES), AND ANY OTHER MATTERS HOWSOEVER ARISING IN RELATION TO THE EVENT.

10.2  You agree that in view of the limited scope of services that CoinGecko is providing in relation to the Event, the maximum aggregate liability of CoinGecko for any and all claims cumulative howsoever connected with this Agreement or the Event, whether in contract, tort or otherwise shall be limited to the amount of the ticket price for the Event paid by you to CoinGecko, or in the event that you have not paid (whether in whole or in part) for any ticket, USD50.

11. Restrictions On Use Of Materials Procured from the Event

11.1   All information, materials and content (collectively, “Event Materials” which shall include without limitation video recordings, interviews, audio clips, presentation slides, notes, handouts, and content on our website) is owned by CoinGecko and/or the third parties owning such Event Materials. Except with the prior written consent of CoinGecko and the said third party owners, no Event Materials (or part thereof) shall be reproduced, republished, uploaded, posted, transmitted or otherwise distributed in any way.

11.2   Subject to Clause 11.1 above, CoinGecko hereby grants you a non-exclusive, non-transferable, revocable, limited right to keep one copy of the Event Materials and to use such one copy for your own non-commercial personal informational/educational purpose only, provided that you keep intact all accompanying copyright and other proprietary notices. Any further duplication, use, display, dissemination or modification of any of the Event Materials or use of the Event Materials for any other purpose without the prior written consent of Coingecko will be a violation of CoinGecko’s (and any other third party owners’) copyright and other intellectual property rights.

 12. Intellectual Property

12.1 Except as pursuant to the limited license granted thereunder Clause 11.2 above, all content (including without limitation videos, illustrations, music, sound, graphics, photos, images, articles and write-ups) provided in relation to the Event are protected by copyright and may not be reproduced or appropriated in any manner without the prior written consent of CoinGecko and their respective copyright owners.

12.2 All trademarks, branding, logos, slogans and company names displayed or used in association with the Event are intellectual property belonging to CoinGecko and their respective third party owners, and cannot be howsoever duplicated, reproduced, modified, published or used without the prior written consent of CoinGecko and the respective third party owners. 

12.3 All intellectual property rights in and to the Event and all content and material distributed at the Event are owned or controlled by or licenced to either CoinGecko or their Third Party Participants presenting or howsoever participating at the Event. You may not use or reproduce or allow anyone to use or reproduce any content or material used at the Event or any intellectual property thereof for any reason without the prior written consent of CoinGecko.

13. Software

All software used on or in connection with the Event (hereinafter referred to as the “Software“) is the property of CoinGecko or its software suppliers and is protected by copyright laws. CoinGecko grants you a limited, revocable (at the sole discretion of CoinGecko), non-exclusive, non-transferable, personal licence to access and use the Software on a single computer, smart phone or tablet, provided that you do not (and do not allow any third party to) copy, modify, adapt, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicence or grant a security interest in or otherwise transfer any right in the Software. For the avoidance of doubt, this licence shall not operate as any transfer of title.

14. No Exploitation For Commercial Purpose

No part of the Event (including our website, any photographs, recordings or the Event Materials) or any part thereof may be reproduced, duplicated, copied, circulated, distributed, sold, resold, visited or otherwise howsoever exploited for any commercial purpose without the prior written consent of CoinGecko.

15. Representations And Warranties

15.1 You hereby represent and warrant that during your access to, or attendance at, the Event, you will behave respectfully (including not making any derogatory, defamatory or racially discriminatory remarks) to all other participants of, and attendees at, the Event, including without limitation not harassing any other persons, causing a ruckus, engaging in multi-level marketing activities, creating any type of hazards or security risks (whether physically at the Event venue or online), nor commiting any criminal acts or acts that breach any laws or any provisions of these Event Terms. 

15.2 Depending on the severity of violations of Clause 15.1 above, warnings may be issued or an immediate removal from the Event venue without any refund, and potentially a ban from all future events held by CoinGecko.  For the avoidance of doubt, CoinGecko reserves the absolute right to refuse admission or evict any person(s) whose conduct is deemed disorderly or inappropriate or who poses a threat to security, or to the enjoyment of the Event by others, as determined by CoinGecko in its sole and absolute discretion, without refund or compensation or liability of any kind to such person(s).

15.3 You further warrant that you will not seek to procure the Personal Data of other individuals without their prior consent, or to use such Personal Data for your commercial gains (such as multi-level marketing) without the prior consent of such Personal Data owner.

15.4 You undertake to keep your ticket and all login details (if any) securely and in the event of any loss thereto and you are unable to access or attend the Event, no refunds or compensation of any kind shall be provided by CoinGecko.

15.5 You warrant that you are responsible for your personal well-being, health and personal property during the Event, and you attend or access the Event at your own risk, and shall not howsoever hold CoinGecko or any of the third party participants at the Event liable for any injuries, health-related issues, loss or damage to personal property.

15.6. Virtual attendees to the Event undertake to be responsible for their own equipment, technical requirements, and internet connectivity to access the Event online, and shall not howsoever hold CoinGecko responsible in the event that the virtual attendee is unable to access (wholly or partially) the Event online.

16. Indemnity

You hereby agree to hold harmless, defend and fully indemnify CoinGecko and all its officers, directors, owners, agents, employees, content and information providers, affiliates, collaborating partners, third party participants/presenters/booth-operators at the Event, licensors and licensees (collectively, the “Indemnified Parties“) harmless from and against any and all claims, losses, liabilities, expenses, damages and costs (including without limitation legal fees on a solicitor-client basis) incurred by any of the Indemnified Parties in connection with damages, losses, costs and claims arising out of any of your omissions or acts howsoever associated with the Event, including without limitation your use of any of the Event Materials, your behaviour at the Event, or any breach by you of this Agreement. You shall co-operate as fully as reasonably required by CoinGecko in the defence of any claim. CoinGecko reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to full indemnification by you as per the foregoing, and you shall not in any event settle any matter without the prior written consent of CoinGecko.

17. Use of our Website & Third Party Websites

Your use of our website in relation to the Event as well as any third party websites linked to our website is as set forth in our Website Terms of Use.  Please therefore read carefully our Website Terms of Use, as well as the terms of the linked third party websites (should you wish to access such third party websites), and if you do not agree with any of the terms, please do not continue to register for or howsoever use our website (or such third party websites, as the case may be) in relation to the Event. 

18. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Singapore, and you agree to submit to the non-exclusive jurisdiction of the courts of Singapore.

19. Third Parties Rights

No person shall have any right pursuant to the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any of the terms and conditions herein.  The reference to a person in this clause includes any individual, company, corporation, firm, partnership, joint venture, association, organisation, trust, state or agency of a state (in each case, whether or not having separate legal personality).
